By accessing or using Pick Party (“the App”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
By accessing or using the App, you represent and warrant that you are at least 18 years of age. We do not knowingly permit anyone under the age of 18 to register for an account, play, or otherwise use Pick Party. If we become aware that a user is under 18, we reserve the right to suspend or terminate that account and forfeit any associated virtual currency or items.
To use Pick Party, you must:
Pick Party is a free-to-play sports prediction game for entertainment purposes only. No real money is wagered, won, or lost through gameplay. Virtual tokens and other in-app items have no real-world monetary value and cannot be redeemed, exchanged, or cashed out for real currency, goods, or services. Pick Party does not constitute gambling, sports betting, or any form of wagering under any applicable law.
Pick Party offers optional in-app purchases including season passes and token packs. By making a purchase, you agree to the following:
The App is licensed, not sold, to you for use only under the terms of these Terms of Service together with Apple’s standard Licensed Application End User License Agreement (the “Apple Standard EULA”). Your license to use Pick Party on any Apple-branded device is governed by the Apple Standard EULA, which is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
You acknowledge that these Terms are entered into between you and Pick Party only, and not with Apple. Apple is not responsible for the App or its content, and is not responsible for providing any maintenance or support for the App. In the event of any conflict between these Terms and the Apple Standard EULA, the Apple Standard EULA will govern solely with respect to your use of the App on Apple devices, to the extent required by Apple.
Tokens and other virtual items in Pick Party:
Pick Party has zero tolerance for objectionable content and abusive users. This policy covers every piece of content users create in the App — chat messages, display names, party (group) names, and avatar photos.
When using Pick Party, you agree not to:
Enforcement. The App filters objectionable language, and every user can report content (long-press a message, or use a member’s menu) and block abusive users (blocking immediately removes their content from your feed and notifies our moderation team). We review every report and act within 24 hours — removing the offending content and ejecting the user who provided it where warranted. Violations may result in immediate suspension or permanent termination of your account without notice.
Pick Party and its content, features, and functionality are owned by Pick Party and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
Pick Party is an independent product of Understory Labs LLC. It is not affiliated with, endorsed by, sponsored by, approved by, or licensed by any sports league, team, franchise, athlete, governing body, broadcaster, or event organizer.
Team, league, athlete, and event names appear in the App solely to identify the real-world games and competitions you may make predictions on. This is descriptive reference only and does not imply any relationship with, or endorsement by, the owners of those names. All trademarks, service marks, and trade names are the property of their respective owners.
The App does not use official league or team logos, crests, wordmarks, or uniform designs. The jersey, helmet, and other team illustrations shown in the App are original artwork created by Understory Labs LLC, rendered in publicly reported team colors; they are not reproductions of any official uniform, mark, or design.
Scores, schedules, and results are factual sporting outcomes. Odds and lines are supplied by third-party sports-data providers. If you are a rights holder and believe any content in the App infringes your rights, please contact us at cole@pickparty.app and we will respond promptly.
We reserve the right to suspend or terminate your account at any time for violations of these terms or for any other reason at our discretion. You may also delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately, and any virtual currency or items associated with your account will be forfeited.
Pick Party is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the App will be error-free, uninterrupted, or meet your specific requirements. Sports data and game results are provided for entertainment purposes and may not always be accurate or up-to-date.
To the maximum extent permitted by law, Pick Party and its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or interruption of service.
These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of the App shall be resolved in accordance with applicable law.
We may update these Terms of Service from time to time. Continued use of the App after changes constitutes acceptance of the new terms. We encourage you to review these terms periodically.
